Biaya yang Berkaitan dengan Pelaksanaan Permintaan
1. Negara Peminta harus. atas permintaan Negara Diminta, mengganti biaya dan
pengeluaran berikut yang timbul dari pelaksanaan permintaan
- tunjangan, biaya perjalanan. dan uang harian untuk saksi dan
perwakilannya, jika ada;
- biaya yang berkaitan dengan pemindahan orang yang ditahan;
- biaya jasa profesi, biaya perjalanan, dan uang harian untuk para ahli:
- tunduk pada kesepakatan lain antara Para Pihak, biaya yang berkaitan
dengan pemeriksaan melalui konferensi video berdasarkan Pasal 24: biaya
untuk membuat tautan video di Negara Diminta, upah penerjemah yang
disediakan, tunjangan untuk saksi dan ahli, serta biaya perjalanan mereka
di Negara Diminta.
1. Jika pelaksanaan permintaan menyebabkan biaya yang sangat besar, Negara
Diminta harus memberi tahu Negara Peminta untuk menentukan syarat clan
ketentuan agar bantuan yang diminta dapat diberikan.
## BAB V-PENGIRIMAN DAN PEMBERIAN INFORMASI SECARA SPONTAN
Pasal32
Pengiriman lnformasi atau Bukti Secara Spontan
1. Melalui saluran Otoritas Pusat dan dalam batasan yang diberikan oleh hukum
nasionalnya, otoritas yang berwenang dari suatu Pihak dapat. tanpa
permintaan sebelumnya, mengirimkan kepada Otoritas Pusat Negara Pihak
lainnya informasi atau bukti yang dikurnpulkan selama proses penyelidikan
dan penyidikan atau penuntutan yang dilakukan olehnya apabila ditentukan
bahwa pengiriman tersebut
- memungkinkan pengajuan permintaan sesuai dengan Perjanjian ini;
- memungkinkan dimulainya proses hukum pidana; atau
- memfasilitasi penyelidikan dan penyidikan tindak pidana yang tertunda.

1. Otoritas yang menyediakan informasi tersebut, sesuai dengan hukum
nasionalnya, dapat menetapkan syarat-syarat terkait penggunaan informasi
tersebut oleh Negara Penerima. Negara Penerima harus terikat oleh
ketentuan ini.
Pasal33
Pemberian informasi untuk tujuan penuntutan atau perampasan
1. lnformasi yang diberikan oleh satu Pihak dengan maksud untuk melakukan
penuntutan di pengadilan Pihak lain atau untuk merampas hasil kejahatan
harus dikomunikasikan di antara Otoritas Pusat.
1. Otoritas Pusat Negara Diminta harus memberitahukan kepada Negara
Peminta setiap tindakan yang diambil atas informasi tersebut dan harus
meneruskan salinan dari catatan setiap putusan yang dijatuhkan.
Pasal34
Terjemahan
### Pasal 30 berlaku secara analogis pada terjemahan dari informasi dan bukti yang
disampaikan dan inforrnas: yang ditetapkan sesuai Pasal 32 dan Pasal 33.
Dokumen yang menyertainya tidak harus diterjemahkan.
## BAB VI - KETENTUAN PENUTUP
Pasal35
Kesesuaian dengan Perjanjian Lain atau Bentuk Kerja Sama Lainnya
Ketentuan dalam Perjanjian ini tidak akan memengaruhi bantuan hukum timbal
balik yang lebih luas yang telah atau mungkin disepakati antara Para Pihak dalam
perjanjian atau pengaturan lain atau yang dihasilkan dari hukum nasional.

Pasal36
Konsultasi
Para Pihak harus berkonsultasi satu sama lain, secara lisan atau tertulis, pada
waktu yang disepakati oleh keduanya, untuk mendorong pelaksanaan yang
paling efektif dari Perjanjian ini, secara umum atau dalam kasus tertentu. Para
Pihak juga dapat menyetujui langkah praktis yang mungkin diperlukan untuk
memfasilitasi pelaksanaan Perjanjian ini.
Pasal37
Penyelesaian Perselisihan
Segala perselisihan yang timbul dari penafsiran, penerapan, atau pelaksanaan
ketentuan dalam Perjanjian ini diselesaikan melalui saluran diplomatik jika
Otoritas Pusat tidak dapat mencapai kesepakatan.
Pasal38
Amendemen
Perjanjian ini dapat diamendemen kapan saja dengan persetujuan bersama Para
Pihak. Amenclemen tersebut mulai berlaku melalui prosedur yang sama
sebagaimana pemberlakuan Perjanjian ini.
Pasal39
Pemberlakuan dan Pengakhiran
1. Para Pihak harus memberitahukan satu sama lain secara tertulis tentang
selesainya persyaratan domestik masing-masing untuk pemberlakuan
Perjanjian ini. Perjanjian ini akan mulai berlaku pada hari keenam puluh
setelah tanggal diterimanya pemberitahuan yang terakhir.
1. Salah satu Pihak dapat mengakhiri Perjanjian ini kapan saja dengan
memberikan pemberitahuan secara tertulis kepada Pihak lainnya melalul
saluran diplomatik. Dalam hal ini, Perjanjian akan berakhir enam bulan setelah

tanggal diterimanya pemberitahuan tersebut. Pengakhiran tidak akan
berpengaruh pada kasus yang masih berjalan.
SEBAGAI BUKTI, yang bertanda tangan di bawah ini, diberi kuasa oleh masing-
masing Pemerintah, telah menandatangani Perjanjian ini.
OIBUAT dalam rangkap dua di Bern pada tanggal empat bulan Februari 2019,
dalam bahasa lnggris, bahasa Indonesia. dan bahasa Jerman. semua naskah
adalah autentik. Apabila terdapat perbedaan penafsiran, maka naskah bahasa

Hereinafter referred to as the Contracting Parties
CONSIDERING the ties of friendship and cooperation uniting them;
ACKNOWLEDGING that the fight against transnational crime is a shared
responsibility of the international community;
AWARE that it is necessary to strengthen legal cooperation, in particular mutual
legal assistance, in order to avoid the increase of criminal activities;
DESIRING to extend to each other the widest measure of mutual legal assistance
to combat crime and to improve the effectiveness of cooperation in the
investigation, prosecution and punishment of crime;
IN OBSERVANCE of their respective Constitution, laws and regulations as well
as the principles of international law. in particular sovereignty, territorial integrity
and non-intervention and respecting the internal legal order of each of the
Contracting Parties;

HAVING REGARD to the principles laid down in the relevant international
conventions, including in the field of human rights. and in an endeavour to
cooperate in view of their advancement;
Have agreed the following:
### CHAPTER I - GENERAL PROVISIONS
Article 1
Obligation to Provide Mutual Legal Assistance in Criminal Matters
The Contracting Parties undertake to provide each other, in accordance with the
provisions of this Treaty, the widest measure of mutual legal assistance in
criminal matters in any investigations, prosecutions or proceedings in respect of
offences the punishment of which. at the time of the request for assistance. falls
within the jurisdiction of the judicial authorities of the Requesting State.
Article 2
Scope of the Assistance
1. Assistance shall include the following measures taken to advance criminal
proceedings in the Requesting State:
- taking testimony or other statements;
- transmitting objects, documents, records and evidence;
- handing over of objects and assets for the purpose of confiscation or
return;
- searching of persons and of property;
- locating and identifying persons and property, including examining objects
and sites;
- tracing, freezing, seizing and confiscating proceeds and instrumentalities
of crime:

- making available detained persons with a view to interrogation or
confrontation;
- inviting witnesses and experts to appear and provide testimony in the
Requesting State;
- any other assistance consistent with the objectives of this Treaty mutually
acceptable to the Contracting Parties provided that it is not incompatible
with the laws of the Requested State.
1. This Treaty shall also apply to any request for mutual legal assistance relating
to acts or omissions committed before its entry into force.
1. The Contracting Parties provide each other the widest measure of mutual
legal assistance in criminal matters with regard to fiscal offences in
accordance with their respective national law.
Article 3
Exclusion
This Treaty shall not apply to the following cases:
- location, arrest or detention of a person prosecuted or convicted of an offence
with a view to extradition:
- execution of penal judgements;
- transfer of sentenced persons for the purpose of serving their sentence;
- transfer of proceedings in criminal matters.
Article 4
Grounds for Refusing or Postponing Assistance
1. Mutual legal assistance in criminal matters may be refused if:
- the request concerns an offence which the Requested State considers a
political offence or an offence connected with a political offence;
- the request concerns an offence under military law which is not an offence
under ordinary criminal law:
- the Requested State considers that the execution of the request is likely to
prejudice the sovereignty, security, public order or other essential interests
of its country as determined by the competent authority;

- the request concerns facts on the basis of which the prosecuted person
has been finally acquitted. pardoned or convicted in the Requested State
for an essentially similar offence, provided the penalty imposed is currently
being carried out or has already been carried out
- there are substantial grounds for believing that the request for assistance
has been presented in order to prosecute or to punish a person on account
of his or her race. religion, nationality, ethnic origin, sex or political opinions
or that the granting of the request could result in aggravating the situation
of this person for any of these reasons;
- there are substantial grounds for believing that the criminal proceeding
against the prosecuted person is not in conformity with the guarantees
contained in international instruments for the protection of human rights,
including the International Covenant on Civil and Political Rights of 16
December, 1966;
- the request relates to an offence which carries the death penalty in the
Requesting State unless the Requesting State gives such assurances as
the Requested State considers sufficient that the death penalty will not be
sought, imposed or, if imposed, will not be carried out.
1. The Requested State may postpone mutual legal assistance if the execution
of the request would interfere with a criminal proceeding under way in the
Requested State.
1. Before refusing or postponing mutual legal assistance in accordance with this
Article, the Requested State shall:
- promptly inform the Requesting State of the reasons for considering the
refusal or postponement of assistance; and
- consider whether assistance can be given on such terms and conditions
as it deems necessary. If so, those terms and conditions shall be complied
with by the Requesting State.

### CHAPTER 11 - REQUESTS FOR MUTUAL LEGAL ASSIST ANGE
Article 5
Applicable Law
1. A request shall be executed in accordance with the law of the Requested
State.
1. If the Requesting State desires the application of a specific procedure with
regard to the execution of a request for mutual legal assistance, it shall
expressly so request, and the Requested State shall comply with the request
if its law does not prohibit it.
Article 6
Dual Criminality and Compulsory Measures
1. The execution of requests involving compulsory measures shall be granted
only if the alleged conduct constitutes an offence under the laws of both
Contracting Parties.
1. In determining whether the alleged conduct constitutes an offence under the
laws of both Contracting Parties, it shall be irrelevant whether the law of both
Contracting Parties places the alleged conduct within the same category of
offence or denominates the offence by the same terminology. The facts
described in the request have to correspond to the objective elements of an
offence punishable under the law of the Requested State.
1. Compulsory measures include:
- searching of persons and of property;
- seizing of evidence, including the instruments used in the commission of
the offence, as well as the objects and assets constituting the products of
the offence;
- any measure aiming at the lifting of secrets protected by the criminal law
of the Requested State: and
- any other measure which involves coercion pursuant to the procedural law
of the Requested State.

1. Dual criminality shall not be requested for the execution of requests not
involving compulsory measures.
Article 7
Provisional Measures
Upon explicit request by the Requesting State, provisional measures shall be
ordered by the competent authority of the Requested State to preserve the
existing situation, to safeguard threatened legal interests orto protect jeopardised
evidence, if the proceeding envisaged by the request does not appear obviously
inadmissible or inappropriate under the law of the Requested State.
Article 8
Limits on Use of Information, Documents and Objects
1. The Requesting State shall not disclose or use information or evidence
furnished for purposes other than those stated in tile request without the prior
consent of the Central Authority of the Requested State.
1. This consent is not necessary if:
- the foreign criminal proceeding is directed against other persons having
participated in committing the offence; or
- the materials are used for an investigation or a proceeding concerning the
compensation for damages connected with a proceeding for which
assistance has been granted.
Article 9
Personal data
1. Personal data transmitted on the basis of this Treaty shall only be used for
the purposes for which the data were transmitted and subject to such
conditions as the transmitting State determines. Subject to the exceptions
according to Article 8 para. 2 lit. a - b, use of the data for other purposes
requires the prior consent of the State transmitting the data.

1. The following provisions shall apply to the transmission and use of personal
data transmitted for the purpose of a request for assistance under this Treaty·
- Only data that relates to the request shall be transmitted to the competent
authority of the Requesting State
- Upon request, the Contracting Party which has received the data shall
inform the transmitting State of the use made of the data and the results
achieved therefrom.
- If it appears to the transmitting State that incorrect data have been
transmitted or that data have been transmitted that should not have been,
the transmitting State shall notify without delay the State that has received
the data; the State that has received the data shall without delay rectify
any errors or destroy the data.
- The Contracting Parties shall keep records in a readily retrievable form
concerning the transmission and receipt of data.
- Onward transfers of personal data shall only be permitted in compliance
with the national legislation and with the prior consent of the transmitting
State.
- Transmitted data that are no longer used for the purposes permitted
pursuant to the Treaty shall be destroyed without delay, or other measures
permitted pursuant to domestic law shall be taken which serve the nght of
the affected person in the same way.
1. The Contracting Parties shall protect personal data against accidental loss,
accidental or unauthorized destruction or modification, unauthorized access,
use or disclosure or other misuse.
1. The Contracting Parties shall guarantee the legitimate rights of the person
affected by the transmission of the data under this Treaty with regard to
information and access to data concerning him or her, correction or deletion
of such data or restriction of tneir processing in appropriate cases, and
effective judicial remedy, upon request of the person concerned. in relation
to the transmission or use of the information.
1. Each Contracting Party may wholly or partly restrict the rights of the person
concerned with regard to information and access to data, including
information with regard to any refusal of rectification or erasure of personal
data or restriction of processing, if this constitutes a necessary and

proportionate measure in order to take into account legitimate interests so as
to safeguard public and national security, protect rights and freedoms of
others, avoid obstructing legal inquiries, investigations or proceedings, or
avoid prejudicing the prevention, detection, investigation or prosecution of
criminal offences or the execution of such offences.
Article 10
Presence of Persons Participating in the Proceeding
On the express request of the Requesting State, the Central Authority of the
Requested State shall state the date and place of execution of the request.
Officials and persons involved may be present if the Requested State consents.
Article 11
Depositions of Witnesses in the Requested State
1. Witnesses shall be heard in accordance with the law of the Requested State.
However. they may also refuse to testify if the law of the Requesting State
allows them to do so.
1. If their refusal to testify is based on the law of the Requesting State, the
Requested State shall send the matter to the Requesting State for decision.
Reasons shall be given for that decision
1. A witness invoking the right to refuse to testify cannot be the subject of any
legal penalty in the Requesting State for that reason.
Article 12
Transmission of Objects, Documents, Records or Evidence
1. Upon request, the Requested State shall transmit objects, documents.
records or evidence to the Requesting State.
1. The Requested State may transmit copies of documents. records or evidence
requested. If the Requesting State expressly requests the transmission of
originals. the Requested State shall make every effort to comply with the
request.

1. The Requesting State is required to return what was transmitted as quickly
as possible or at the latest after the end of the proceeding unless the
Requested State expressly waives the return thereof.
1. Rights claimed by third parties to objects, documents, records or evidence in
the Requested State shall not prevent their transmission to the Requesting
State.
Article 13
Records of Judges, Courts or Investigating Authorities
1 Upon request. the Requested State shall make available to the authorities of
the Requesting State its records of courts or investigating authorities,
including judgements and decisions, if these records are important for a
judicial proceeding.
1. Documents. records and other materials shall only be handed over if they
concern a case which has been closed If the case has not been closed. the
competent authority of the Requested State shall judge whether it is
permissible.
Article 14
Judicial Records and Exchange of Information
1. The Requested State shall communicate extracts from and information
relating to judicial records, requested by the judicial authorities of the
Requesting State and needed in a criminal matter, to the extent permitted by
national law.
1. In any case other than that provided for in paragraph 1 of this Article, the
request shall be complied with in accordance with the conditions provided for
by the law regulations or practice of the Requested State
1. The Contracting Parties may, in accordance with their respective national
law, provide information on all criminal convictions and subsequent measures
entered m the judicial records in respect of the nationals of the other
Contracting Party.

Article 15
Handing over of Objects and Assets
1. Objects and assets constituting the product or profits of an offence
prosecuted by the Requesting State and the instruments having served to
commit the offence which are subject to a precautionary seizure. or their
replacement value, may be handed over to the Requesting State for the
purpose of confiscation or return to the person entitled, subject to the rights
of bona fide third parties.
1. As a rule, the handing over shall intervene based on a final and executable
order or sentence of the Requesting State. however, objects and assets may
also be handed over by the Requested State, based on domestic law and
after mutual consent between the Contracting Parties, in a previous phase of
the proceeding if their illicit ongin is obvious.
Article 16
Sharing of Confiscated Assets
1. The Contracting Parties undertake to afford each other the widest
cooperation in sharing matters according to their national laws.
1. In order to share confiscated assets in the sense of this Article, the
Contracting Parties shall conclude, for each individual case, a specific
agreement or arranqeme-it laying down the particular conditions for the
request, the handing over and transfer of the shared assets
Article 17
Controlled Delivery
1. Each Contracting Party undertakes to ensure that at the request of the other
Contracting Party, controlled deliveries may be permitted on its territory in the
framework of criminal investigations mto extraditable offences.
1. The decision to carry out controlled deliveries shall be taken in each individual
case by the competent authorities of the Requested State. with due regard to
the national law of that State.

1. Controlled deliveries shall take place in accordance with the procedures of
the Requested State. Competence to act, direct and control operations shall
lie with the competent authorities of that State.
### CHAPTER 111 - SERVING AND APPEARANCES
Article 18
Service of Writs and Records of Judicial Verdicts
1. The Requested State shall effect service of writs and records of judicial
verdicts which are transmitted to it for this purpose by the Requesting State.
1. Service may be effected by simple transmission of the writ or record to the
person to be served by the Requested State. If the Requesting State
expressly requests, service shall be effected by the Requested State in the
manner provided for the service of analogous documents under its own law
or in a special manner consistent with such law.
1. Proof of service shall be given by means of a receipt dated and signed by the
person served or by means of a declaration made by the Requested State
that service has been effected and stating the form and date of such service.
Either of these documents shall be sent immediately to the Requesting State.
The Requested State shall if the Requesting State so requests state
whether service has been effected in accordance with the law of the
Requested State If service cannot be effected, the reasons shall be
communicated in writing immediately to the Requesting State.
1. The request for service of a document to summon a prosecuted person who
rs in the territory of the Requested State shall reach the Central Authority of
that State at the latest thirty calendar days before the date set for
appearance.
Article 19
Appearance of Witnesses or Experts in the Requesting State
1. If the Requesting State considers the personal appearance of a witness or
expert before its judicial authorities necessary, it shall so mention in its

request for service of the summons and the Requested State shall invite the
witness or expert to appear in the territory of the Requesting State.
1. The Requested State shall, without delay, communicate in writing to the
Requesting State the decision of the witness or expert with regard to the
invitation.
1. A witness or expert who agrees to appear in the Requesting State may
require that State to grant an advance for his or her travel costs and
subsistence.
1. The allowances to be paid and the travel costs and subsistence to be
refunded to a witness or expert by the Requesting State shall be calculated
as from his or her place of residence and at rates at least equal to those
provided for in the scales and rules in force in the State where the hearing is
intencJed to take place.
Article 20
Failure to Appear
A witness or expert who has failed to answer a summons to appear, service of
which has been requested, shall not, even if the summons contains a notice of
penalty, be subjected to any punishment or measure of restraint. unless
subsequently he or she voluntarily enters the territory of the Requesting State
and is there again duly summoned.
Article 21
Safe Conduct
1. A witness or expert, whatever his or her nationality, appearing on a summons
before the judicial authorities of the Requesting State shall not be prosecuted
or detained or subjected to any other restriction of his or her personal liberty
in the territory of that State in respect of acts or convictions anterior to his or
her departure from the territory of the Requested State.
1. A person. whatever his or her nationality, summoned before the judicial
authorities of the Requesting State to answer for acts forming the subject of
proceedings against him or her, shall not be prosecuted or detained or

subjected to any other restriction of his or her personal liberty for acts or
convictions anterior to his or her departure from the territory of the Requested
State and not specified in the summons.
1. Without his or her written consent a person to whom paragraphs 1 and 2 are
applicable shall not be prompted to testify in the context of a proceeding
different from the one forming the basis of the request for mutual legal
assistance.
1. The immunity provided for in this Article shall cease when the witness or
expert or prosecuted person, having had. for a period of thirty consecutive
days from the date when his or her presence rs no longer required by the
judicial authorities, an opportunity of leaving the Requesting State, has
nevertheless remained in that territory, or having left it, has returned.
1. A person who consents to appear pursuant to Article 19 or Article 23 shall not
be subject to prosecution based on his or her testimony, except for perjury
Article 22
Extent of Testimony in the Requesting State
1. A person appearing on a summons in the Requesting State may be
compelled to give testimony or to produce a piece of evidence unless under
the law of either Contracting Party he or she has a right co refuse.
1. Article 8 and Article 11, paragraphs 2 and 3 shall apply by analogy.
Article 23
Temporary Transfer of Detained Persons
1. A person in custody whose personal appearance as a witness or for purposes
of confrontation is applied for by the Requesting State shall be temporarily
transferred to the location where the hearing is intended to take place,
provided that he or she shall be sent back to the territory of the Requested
State within the period as stipulated by the latter and subject to the provisions
of Article 21 of this Treaty insofar as these are applicable.
1. Transfer may be refused if:
- the person in custody does not consent

- his or her presence is necessary at a criminal proceeding pending in the
territory of the Requested State;
- transfer could prolong his or her detention:
- the Requesting State is not in a position to comply with any conditions
specified by the Requested State relating to the custody or security of the
person to be transferred; or
- there are other overriding grounds for not transferring him or her to the
territory of the Requesting State.
1. The transferred person shall remain in custody in the territory of the
Requesting State, unless the Requested State applies for his or her release.
1. The person transferred shall receive credit for service of the sentence
imposed in the Requested State for the period of time served in the custody
of the Requesting State.
Article 24
Hearing by Video Conference
1. If a person is in one Contracting Party's territory and has to be heard as a
witness or expert by the judicial authorities of the other Contracting Party, the
latter may, where it is not desirable or possible for the person to be heard to
appear in its territory in person, request that the hearing take place by video
conference, as provided for in paragraphs 2 to 6 of this Article.
1. The Requested State shall agree to the hearing by video conference provided
that the use of the video conference is not contrary to its fundamental
principles. If the Requested State has no access to the technical means for
videoconferencing, such means may be made available to it by the
Requesting State by agreement between them.
1. The judicial authority of the Requested State shall summon the person
concerned to appear in accordance with the forms prescribed by its
legislation.
1. With reference to hearing by video conference, the following rules shall apply:
- a judicial authority of the Requested State shall be present during the
hearing, where necessary assisted by an interpreter. and shall also be
responsible for ensuring both the identification of the person to be heard

and respect for the fundamental principles of the law of the Requested
State. If the judicial authority of the Requested State is of the view that
during the hearing the fundamental principles of the law of the Requested
State are being infringed, it shall immediately take the necessary
measures to ensure that the hearing continues in accordance with the said
principles;
- measures for the protection of the person to be heard shall be agreed,
where necessary, between the competent authorities of the Requesting
and the Requested State;
- the hearing shall be conducted directly by, or under the direction of, the
judicial authority of the Reauesting State in accordance with its own laws;
- at the request of the Requesting State or the person to be heard, the
Requested State shall ensure that the person to be heard is assisted by
an interpreter, if necessary;
- the person to be heard may claim the right not to testify which would
accrue to him or her under the law of either the Requested or the
Requesting State.
1. Without prejudice to any measures agreed for the protection of persons, the
judicial authority of the Requested State shall on the conclusion of the hearing
draw up minutes indicating the date and place of the hearing, the identity of
the person heard, the identities and functions of all other persons in the
Requested State participating in the hearing, any oaths taken and the
technical conditions under which the hearing took place. The document shall
be forwarded by the competent authority of the Requested State to the
competent authority of the Requesting State .
', : 6. Each Contracting Party shall take the necessary measures to ensure that,
where witnesses or experts are being heard within its territory, in accordance
with this Article, and refuse to testify when under an obligation to testify or do
not testify according to the truth. its national law applies in the same way as
if the hearing took place in a national procedure.
1. Each Contracting Party may at its discretion also apply the provisions of this
Article, where appropriate and with the agreement of their competent judicial
authorities, to hearings by video conference involving the accused person or
the suspect. In this case, the decision to hold the video conference. and the

manner in which the video conference shall be carried out, shall be subject
to agreement between the Contracting Parties. in accordance with their
national law and relevant international instruments, including the International
Covenant of 16 December 1966 on Civil and Political Rights. Hearings
involving the accused person or the suspect shall only be carried out with his
or her consent.
### CHAPTER IV-PROCEDURE
Article 25
Central Authority
1. For the purposes of this Treaty, the Central Authority for the Republic of
Indonesia is the Ministry of law and Human Rights and for the Swiss
Confederation is the Federal Office of Justice of the Federal Department of
Justice and Police.
1. The Central Authorities submit requests for mutual legal assistance in
criminal matters covered by this Treaty on behalf of their competent
authorities and receive requests made by the other Contracting Party.
1. The Central Authority of the Requested State shall treat the requests for
mutual legal assistance as quickly as possible and, where applicable,
transmit them for execution to their competent authorities. The Central
Authority keeps the coordination of the execution of these requests.
1. The Central Authorities of the Contracting Parties shall communicate directly
with each other.
1. The Central Authorities of the Contracting Parties may communicate in
English.
1. Either Contracting Party may change its Central Authority. in which case
notice shall be given in writing through diplomatic channels.

Article 26
Form of the Request and Channels of Transmission
1. The request for mutual legal assistance shall be made in writing.
1. The request may be transmitted, in case of urgency, by fax or by any other
means admitted by the Requested State. The original of the request shall be
dispatched within eight days.
Article 27
Contents of the Request
1. A request shall indicate:
- the name of the authority conducting the investigation, prosecution or
judicial proceedings to which the request relates;
- the object of and the reason for the request
- a detailed description of the pieces of evidence, the information or the
measures requested,
- where possible, the complete name, place and date of birth, nationality
and the current address of the person who is the subject of the criminal
proceeding;
- the principal reason why evidence or information is requested, as well as
a summary of the relevant facts (date, place and circumstances in which
the offence was committed) giving rise to the proceeding in the Requesting
State, unless the request is one for service within the meaning of Article
18;
- the link existing between the facts under investigation in the Requesting
State and the measures to be taken in the Requested State;
- the text of statutory provisions. or where this is not possible, a statement
of the relevant law applicable;
- the degree of confidentiality required and the reasons thereof;
- any time limit within which compliance with the request is desired; and
- such other information or undertakings as may be required under the
domestic laws of the Requesting State or which is otherwise necessary for
the proper execution of the request.

1. In addition, a request shall include:
- in the case of application of foreign law with regard to the execution (Article
5, paragraph 2), the text of the provisions which are applicable in the
Requesting State, and the reason for its application:
- in the case of participation of persons to the proceeding (Article 10). the
designation of the person attending the execution of the request, and the
reason for his or her presence;
- the probable place and the description of the objects and assets
constituting the products or profits of an offence or the instruments which
served to commit the offence or the main reason why these objects and
assets are supposed to be located in the territory of the Requested State;
- in the case of service of writs and records of judicial verdicts and of
summons (Article 18 and Article 19) the name and address of the person
to be served;
- in the case of summons of witnesses or experts (Article 19), a statement
that the Requesting State will pay for expenses and allowances and that it
will, if requested to do so, pay in advance;
- in the case of temporary transfer of detained persons (Article 23), the
names of the latter, an indication of the officials who have the custody
during the transfer, the place to which the detained person rs to be
transferred and the probable date of that person's return;
- in the case of hearings by video conference (Article 24). the reason why it
is not desirable or possible for the witness or expert to attend, the name of
the judicral authority and of the persons who will be conducting the hearing;
- in the case of depositions of witnesses (Article 11, Article 19 and Article
23). the subject matter regarding which the person is to be heard,
including, if necessary, a list of questions to be asked and a description of
any documents, records or articles of evidence to be produced;
- in the case of handing over of objects or assets for confiscation or return
to the entitled person (Article 15) the court order in force, if any, and a
statement about the status of that order:
- any other supporting information, evidence or documents that is necessary
to enable or may assist the Requested State to give effect to the request.

1. If the Requested State considers that the information is not sufficient to
enable the request to be executed, it may request additional information to
enable the request to be dealt with.
Article 28
Execution of the Request
1. Subject to the adoption of provisional measures pursuant to Article 7, the
Central Authority of the Requested State shall. if the request does not
conform to the provisions of this Treaty, inform the Central Authority of the
Requesting State without delay and request the amendment or completion of
the request.
1. If tne request appears to be in conformity with this Treaty, the Central
Authority of the Requested State shall forward it immediately to the authority
competent for its execution.
1. After the request has been executed. the competent authority shall forward
to the Central Authority of the Requested State the request and the
information and evidence gathered. The Central Authority shall be
responsible for ensuring that the execution 1s complete and accurate and
shall communicate the results thereof to the Central Authority of the
Requesting State.
1. Paragraph 3 of this Article shall not hinder a partial execution of the request.
The Requested State shall promptly inform the Requesting State of its
decision not to comply in whole or in part with a request for assistance.
1. The Requested State shall promptly inform the Requesting State of any
circumstances which are likely to cause a significant delay in responding to
the request.

Article 29
Exemption from Legalisation, Authent.ication and other Formality
Requirements
1. All documents. records, statements and other materials transmitted pursuant
to this Treaty are exempted from any legalisation. authentication and other
formality requirements.
1. Documents, records, statements and other materials transmitted by the
Central Authority of the Requested State shall be admitted as evidence
without further justification or proof of authenticity.
Article 30
Language
1. A request made pursuant to this Treaty by the Republic of Indonesia and the
accompanying documents shall be translated into one of the official
languages of the Swiss Confederation (French, German or Italian), as
specified in each case by the Swiss Central Authority. A request made
pursuant to this Treaty by the Swiss Confederation and the accompanying
documents shall be translated into Indonesian.
1. The translation of the documents made or obtained in executing the request
shall be incumbent upon the Requesting State.
1. Any translation carried out by the Contracting Parties is of an official nature.
1. In urgent cases and when agreed by the Central Authorities. requests and
supporting documents may be transmitted in English.
Article 31
Costs Relating to the Execution of the Request
1. The Requesting State shall, at the request of the Requested State, reimburse
only the following costs and disbursements incurred in executing a request:
- allowances, travel costs and subsistence for the witnesses and their
representatives. if any;
- costs relating to the transfer of detained persons:

- fees, travel costs and subsistence for experts;
- subject to any different agreement between the Contracting Parties, costs
relating to hearings by video conference under Article 24: costs for
establishing a video link in the Requested State. the remuneration of
interpreters provided by it and allowances to witnesses and experts and
their travelling expenses in the Requested State.
1. If the execution of the request causes expenses of an extraordinary nature,
the Requested State shall inform the Requesting State thereof to determine
the terms and conditions under which the requested assistance can be
provided.
### CHAPTER V -SPONTANEOUS TRANSMISSION AND LAYING OF
Article 32
Spontaneous Transmission of Information or Evidence
1. Through the channel of its Central Authority and within the limits of its national
law, a competent authority of a Contracting Party may, without prior request,
transmit to the Central Authority of the other Contracting Party information or
evidence gathered in the course of its own criminal investigation or
prosecution, when rt determines that this transmission is of a nature:
- to permit presenting a request pursuant to this Treaty:
- to permit the opening of a criminal proceeding; or
- to facilitate a pending criminal investigation.
1. The authority providing the information may, pursuant to its national law,
impose conditions on the use of such information by the receiving State. The
receiving State shall be bound by these conditions.

Article 33
Laying of information for purposes of prosecution or confiscation
1. Information laid by one Contracting Party with a view to prosecution in the
courts of the other Contracting Party or to confiscation of proceeds of crime
shall be communicated between the Central Authorities.
1. The Central Authority of the Requested State shall notify the Requesting
State of any action taken on such information and shall forward a copy of the
record of any verdict pronounced.
Article 34
Translation
Article 30 applies by analogy to the translation of information and evidence
transmitted and information laid according to Article 32 and Article 33.
Accompanying documents do not have to be translated.
### CHAPTER VI - FINAL PROVISIONS
Article 35
Compatibility with other Agreements or other Forms of Cooperation
The provisions of this Treaty shall not affect more extensive mutual legal
assistance which has been or may be agreed upon between the Contracting
Parties in other agreements or arrangements or resulting from national law.
Article 36
Consultations
The Contracting Parties shall consult each other, orally or in writing. at times
mutually agreed to by them, to promote the most effective implementation of this
Treaty, in general terms or in a particular case. Both Contracting Parties may also
agree on such practical measures as may be necessary to facilitate the
implementation of this Treaty.

Article 37
Settlement of Disputes
Any dispute arising out of the interpretation, application or implementation of the
provisions of this Treaty shall be resolved through diplomatic channels if the
Central Authorities are themselves unable to reach an agreement.
Article 38
Amendment
This Treaty may be amended at any time by mutual consent of the Contracting
Parties. Such an amendment shall enter into force by the same procedure as
applicable for the entry into force of this Treaty.
Article 39
Entry into Force and Termination
1. The Contracting Parties shall notify in writing each other about the completion
of their respective domestic requirements for the entry into force of trus
Treaty. The Treaty shall enter into force on the sixtieth day after the date of
the receipt of the latter notification.
1. Either Contracting Party may terminate this Treaty at any time by giving
notice in writing to the other through diplomatic channels. In that case the
Treaty shall cease to have effect six months after the date of the receipt of
that notification. The termination shall not have any effect on pending cases.

~N DER IERKENNTNIS, dass der Kampf gegen das grenzuberschreitende
Verbrechen eine gemeinsame Verantwortung der intemationalen Gemeinschaft
bildet;
ijM BEWUSSTSEIN, dass die justizielle Zusammenarbeit und insbesondere die
Rechtshilfe qestarkt werden mussen, um die Zunahme verbrecherischer
Tatiqkeiten zu verhindem;
IN DEM WUNSCHE, einander gegenseitig ein Hochstrnass an Rechtshilfe bei
der Verbrechensbekampfung zu leisten und die \Nirksamkeit der
Zusammenarbeit bei der Untersuchung, Verfolgung und Bestrafung von
Verbrechen zu verbessem;

IN EINHALTUNG ihrer jeweiligen Verfassung sowie ihrer Gesetze und
Vorschriften sowie der Grundsatze des Volkerrechts, insbesondere der
Souveranitat, der territorialen Inteqntat und der Nichteinmischung, und in
Achtung der innerstaatlichen Rechtsordnung der beiden Vertragsparteien;
UNTER BERUCKSICHTIGUNG der Grundsatze. die in den elnschlaqiqen
internationalen Obereinkommen. einschliesslich denjenigen im Bereich der
Menschenrechte festgelegt sind und im Bestreben, im Hinblick auf deren
F6rderung zusammenzuarbeiten;
haben Folgendes vereinbart:
Artikel 1
Verpflichtung zur Rechtshilfe in Strafsachen
Die Vertragsparteien verpflichten sich, einander nach den Bestimmungen dieses
Vertrags weitestgehende Rechtshilfe in Strafsachen zu leisten in alien
Ermittlungen, Strafverfolgungen oder Verfahren hinsichtlich strafbarer
Handlungen, deren Ahndung im Zeitpunkt, in dem um Rechtshilfe ersucht wird,
in die Zustandigkeit der Justizbehorden des ersuchenden Staates taltt.
Artikel 2
Umfang der Rechtshilfe
1. Die Rechtshilfe umfasst folgende Massnahmen, die zur UnterstCJtzung eines
Strafverfahrens im ersuchenden Staat getroffen werden:
- die Entgegennahme von Zeugenaussagen oder anderen Aussagen;
- die Obermittlung von Gegenstanden, Schriftstucken. Akten und
Beweismitteln;
- die Herausgabe von Gegenstanden und Vermogenswerten zur Ein-
ziehung oder Ruckerstattunq;

- das Zurvertogungstellen von tnformationen;
- die Durchsuchung von Personen und die Hausdurchsuchung;
- das Auffinden und ldentifizieren van Personen und Eigentum,
einschhesslich der Untersuchung von Gegenstanden und Ortlichkeiten;
- das Aufspuren, das Einfrieren, die Beschlagnahme und das Einziehen
von Ertraqen aus strafbaren Handlungen und von Tatwerkzeugen·
- die Zustellung von Schriftstucken;
- das ZurverfOgungstellen inhaftierter Personen zum Zweck der
Einvernahme oder der GegenOberstellung;
- die Einladung an Zeugen. Zeuginnen und Sachverstandige, im
ersuchenden Staat zu erscheinen und auszusagen.
- alle anderen Massnahmen im Rahmen der Rechtshilfe, die mit den Ziel en
dieses Vertrags vereinbar sind und von den Vertragsparteien akzeptiert
werden konnen, vorausgesetzt, sre sind nicht unvereinbar mit den
Gesetzen des ersuchten Staates.
1. Dieser Vertrag isl auch anwendbar auf Ersuchen um Rechtshilfe im
Zusammenhang rnrt strafbaren Handlungen oder Unterlassungen, die var
seinem lnkrafttreten begangen worden sind.
1. Die Vertragsparteien leisten einander nach ihrern jeweiligen innerstaatlichen
Recht weitestgehende Rechtshilfe in Strafsachen mit Bezug auf fiskalische
strafbare Handlungen
Artikel 3
Unanwendbarkeit
Dieser Vertrag ist nicht anwendbar auf:
- die Vernaftung oder lnhaftierung strafrechtlich verfolgter oder verurteilter
Personen oder die Fahndung nach ihnen zum Zweck ihrer Auslieferung.
- die Vollstreckung van Strafurteilen;
- die Oberstellung verurteilter Personen zur VerbOssung ihrer Strafe;
- die Obertragung der Strafverfolgung.

Artikel 4
Grunde fur die Ablehnung oder den Aufschub der Rechtshilfe
1. Die Rechtshilfe in Strafsachen kann abgelehnt werden. wenn:
- sich das Ersuchen auf eine strafbare Handlung bezieht, die vom
ersuchten Staat als politische Straftat oder als mit einer politischen
Straftat zusarnrnenhanqende strafbare Handlung angesehen wird;
- sich das Ersuchen auf eine nach der Militargeserzgebung strafbare
Handlung bezieht die nach qememern Recht keine strafbare Handlung
darstellt;
- der ersuchte Staat der Ansicht ist, dass die Ausfuhrung des Ersuchens
geeignet ist, die Souverarutat, die Sicherheit, die offentliche Ordnung
oder andere wesentliche Landesinteressen, wie sie von seiner
zustandiqen Behorde festgelegt wurden. zu beeintrachtigen;
- das Ersuchen Handlungen betrifft, aufgrund deren eine strafrechtlich
verfolgte Person im ersuchten S aat wegen einer im Wesentlichen
entsprechenden strafbaren Handlung rechtskraftiq freigesprochen,
begnadigt oder verurteilt wurde, und sofem eine verhanqte sankncn
noch vollzogen wird oder bererts vollzogen ist;
- ernsthafte GrOnde zur Annahrne bestehen, dass das
Rechtshilfeersuchen mit dem Ziel erngereicht wurde, eine Person wegen
ihrer Rasse, rhrer Religion, ihrer Staatsangehorigkeit, ihrer ethnischen
Zugehorigkeit, ihres Geschlechts oder ihrer politischen Anschauungen
zu verfolgen oder zu bestrafen oder dass eine Gutheissung des
Ersuchens dazu fOhren wOrde, dass sich die Situation dieser Person aus
einem der genannten Grunde verschlechtern wurde;
- ernsthafte GrOnde zur Annahme bestehen. dass im Rahmen des
Strafverfahrens gegen die strafrechtlich verfolgte Person die Garantien
nicht berOcksichtigt werden, die in den intemationalen lnstrumenten for
den Schutz der Menschenrechte. insbesondere im lnternationalen Pakt
vom 16. Dezember 1966 Ober bOrgerliche und politische Rechte,
festgehal1en sind;
- sich das Ersuchen auf eine strafbare Hand lung bezieht, tor die nach dem
Recrt des ersuchenden Staates die T odesstrafe vorgesehen ist. es sei

denn, der ersuchende Staat gibt dem ersuchten Staat eine von diesem
als ausreichend erachtete Zusicherung ab, dass die Todesstrafe nicht
beantragt oder verhanqt wird oder dass sie, wenn sie verhanqt wurde,
nicht vollstreckt wird.
1. Der ersuchte Staat kann die Rechtshilfe aufschieben, wenn sich die
Ausfuhrung des Ersuchens nachteilig auf ein hanqiqes Strafverfahren in
diesem Staat auswirken wOrde.
1. Bevor der ersuchte Staat die Rechtshilfe nach diesem Artikel ablehnt oder
aufschlebt:
- teilt er dem ersuchenden Staat umgehend die Grunde mit, die ihn
veranlassen, die Ablehnung oder den Aufschub der Rechtshilfe in
Betracht zu ziehen; und
- pruft er. ob die Rechtsh1lfe unter den ihm erforderlich scheinenden
Bedingungen gewahrt werden kann; trifft dies zu, so mussen diese
Bedingungen im ersuchenden Staat eingehalten werden.
Artikel 5
Anwendbares Recht
1. Oas Ersuchen wird nach dem Recht des ersuchten Staates ausgefOhrt.
1. Wunscht der ersuchende Staat, dass bei der AusfClhrung eines
Rechtshilfeersuchens ein besonderes Verfahren angewendet wird, so hat er
ausdrucklich darum zu ersuchen; der ersuchte Staat gibt dem Ersuchen statt,
sofern sein Recht dem nicht entgegensteht.

Artikel 6
Doppelte Strafbarkeit und Zwangsmassnahmen
1. Einem Ersuchen, dessen Ausfuhrung Zwangsmassnahmen erfardert, wird
nur dann entsprochen, wenn die zur Last gelegte Verhaltensweise qernass
dem Recht beider Vertragsparteien eine Straftat darstellt.
1. Bei der Beurteilung, ob die zur Last gelegte Verhaltensweise qemass dem
Recht beider Vertragsparteien eine Straftat darstellt, ist es unerheblich, ob
das Recht beider Vertragsparteien diese Verhaltensweise derselben
Kategorie van Straftaten zuordnet oder die Straftat gleich bezeichnet. Die im
Ersuchen beschriebenen Handlungen mOssen die objektiven
Tatbestandsmerkmale einer nach dem Recht des ersuchten Staates
strafbaren Handlung aufweisen.
1. Zwangsmassnahmen umfassen:
- die Durchsuchung von Personen und die Hausdurchsuchung;
- die Beschlagnahme van Beweismitteln, einschliesslich der
Tatwerkzeuge, mit denen eine strafbare Handlung begangen wurde,
sowie der Gegenstande und Vermogenswerte, die das Erzeugnis einer
strafbaren Handlung darstellen;
- jede Massnahme, welche die Preisgabe van Geheimnissen bewirkt, die
durch das Strafrecht des ersuchten Staates qeschutzt werden; und
- jede andere Massnahme, die mit der Anwendung van Zwang verbunden
und als solche im Verfahrensrecht des ersuchten Staates vorgesehen ist.
1. Die doppelte Strafbarkeit ist nicht erforderlich tor die AusfOhrung van
Ersuchen, die keine Zwangsmassnahmen erfordern.
Artikel 7
Vorlaufige Massnahmen
Auf ausdruckliches Verlangen des ersuchenden Staates ordnet die zustandiqe
Behorde des ersuchten Staates zur Erhaltung des bestehenden Zustands, zur

1/1/ahrung bedrohter rechtlicher lnteressen oder zur Sicherung qefahrdeter
Beweismjttel vorlauflqe Massnahmen an. wenn das Verfahren, auf das sich das
Ersuchen bezieht. nach dem Recht des ersuchten Staates nicht offensichtlich
unzulassiq oder unzweckmassiq erscheint.
Artikel 8
Beschrankte Verwendung von AuskUnften, SchriftstUcken
und Gegenstanden
1. Der ersuchende Staat dart erhaltene Auskunfte oder Beweismittel nicht ohne
vorgangige Zustimmung der Zentralbehorde des ersuchten Staates fur
andere als die im Ersuchen aufgefOhrten Zwecke offenlegen oder
verwenden.
1. Diese Zustimmung ist nicht eriorderlich, wenn:
- das auslandische Strafveriahren sich gegen andere Personen richtet, die
an der strafbaren Handlung teilgenommen haben: oder
- das Material fur eine Untersuchung oder ein Verfahren bezuqlich der
Leistung von Schadenersatz im Zusammenhang mit einem Verfahren
verwendet wird, fur das Rechtshilfe qewahrt wurde.
Artikel 9
Personenbezogene Oaten
1. Personenbezogene Oaten, die auf der Grundlage dieses Vertrags ubermittelt
werden, dOrfen ausschliesslich fOr die Zwecke verwendet werden, fur die sie
Obermittelt wurden; ihre Verwendung untersteht den Bedingungen, die vom
Obermittelnden Staat formuliert werden. Linter Vorbehalt der Ausnahmen von
Artikel 8 Absatz 2 Buchstaben a und b ist fur die Verwendung zu anderen
Zwecken die vorgangige Zustimmung des Obermittelnden Staates
erforderlich.

1. Fur die Obermittlung und die Verwendung personenbezogener Oaten, die im
Rahmen eines Ersuchens um Rechtshilfe nach diesem Vertrag Obermittelt
werden, gelten die folgenden Bestimmungen:
- Der zustandiqen Behorde des ersuchenden Staates werden nur Oaten
Obermittelt, die einen Bezug zum Ersuchen haben.
- Auf Anfrage informiert die Vertragspartei. welche die Oaten erhalten hat
den Staat, der die Oaten Obermittelt hat, Ober die Verwendung der Oaten
und die erzielten Ergebnisse.
- Stellt der Obermittelnde Staat fest. dass unrichtige Oaten uberrnittelt
wurden oder Oaten, die nicht batten uberrnittelt werden sollen, so
benachrichtigt dieser Staat den Staat, der die Oaten erhalten hat,
unverzuqlich. Der Staat, der die Oaten erhalten hat. korrigiert allfallige
Fehler umgehend oder vernichtet die erhaltenen Oaten.
- Die Vertragsparteien fOhren Aufzeichnungen in leicht abrufbarer Form
betreffend die Obermittlung und den Erhalt der Oaten.
- Die WeiterObermittlung personenbezogener Oaten ist ausschliesslich in
Obereinstimmung mit dem innerstaatlichen Recht und mit vorgangiger
Zustimmung des Obermittelnden Staates gestattet.
- Obermittelte Oaten. die nicht lanqer tor die nach diesem Vertrag
zulassiqen Zwecke ben6tigt werden. sind unverzOglich zu vernichten:
